1. Acceptance of Terms

By accessing, browsing, or using the ChangeCoinNow website (hereinafter referred to as "the Service," "we," "us," or "our"), located at changecoinnow.com, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use. If you do not agree with any part of these terms, you must immediately discontinue use of the Service.

We reserve the right to modify these Terms at any time without prior notice. Continued use of the Service following the posting of changes constitutes acceptance of those changes. We encourage you to review these Terms periodically.

2. Description of Service

ChangeCoinNow is a non-custodial cryptocurrency exchange aggregation platform. The Service enables users to exchange one cryptocurrency for another through third-party liquidity providers. We do not hold, store, or manage user funds at any time during the exchange process.

The Service operates as an interface that facilitates cryptocurrency exchanges. When you initiate an exchange, you send your cryptocurrency to an address generated by our liquidity partner, and the exchanged cryptocurrency is sent directly to the wallet address you provide.

ChangeCoinNow does not operate as a bank, financial institution, custodian, or money transmitter. We do not provide investment advice, financial planning, brokerage services, or any form of regulated financial service.

3. Eligibility

By using the Service, you represent and warrant that:

• You are at least 18 years of age or the age of legal majority in your jurisdiction, whichever is greater.
• You have the legal capacity and authority to enter into these Terms and to use the Service.
• Your use of the Service does not violate any applicable law, regulation, or rule in your jurisdiction.
• You are not located in, a citizen of, or a resident of any country or territory subject to comprehensive economic sanctions, including but not limited to North Korea, Iran, Syria, Cuba, and the Crimea region.
• You are not listed on any government list of prohibited or restricted parties.
• You will not use the Service for any illegal or unauthorized purpose, including but not limited to money laundering, terrorist financing, tax evasion, fraud, or the purchase of illegal goods or services.

4. Account and Registration

ChangeCoinNow does not require users to create an account or register to use the basic exchange functionality of the Service. No personal information such as name, email address, or identification documents is required to perform a standard cryptocurrency exchange.

However, in certain circumstances, our compliance procedures or those of our liquidity partners may require additional verification in accordance with applicable Anti-Money Laundering (AML) and Know Your Customer (KYC) regulations. You agree to provide accurate and complete information if such verification is requested.

5. Exchange Transactions

5.1 Initiating an Exchange

When you initiate an exchange through the Service, you agree to the exchange rate and estimated amount displayed at the time of the transaction. Exchange rates are sourced from our liquidity partners and are subject to market fluctuations.

5.2 Standard Rate vs. Fixed Rate

Standard rate exchanges may result in a final amount that differs from the initial estimate due to market volatility during the exchange process. The rate is determined at the moment of exchange execution, not at the time of order creation. Fixed rate exchanges, when available, lock in the rate for a limited period. If the deposit is not received within the specified timeframe, the fixed rate may expire.

5.3 Minimum and Maximum Amounts

Each exchange pair may have minimum and maximum amount requirements. These limits are determined by our liquidity partners and may change without prior notice. The Service will display applicable limits during the exchange creation process.

5.4 Deposit Requirements

You are responsible for sending the correct amount to the correct deposit address within the specified timeframe. You must also include any required memo, destination tag, extra ID, or payment ID when applicable. Failure to include required additional identifiers (such as memos for Stellar XLM, destination tags for Ripple XRP, or extra IDs for other applicable networks) may result in permanent and irrecoverable loss of funds.

5.5 Transaction Finality

Cryptocurrency transactions are irreversible once confirmed on the blockchain. ChangeCoinNow cannot reverse, cancel, or modify a transaction after it has been broadcast to the network. You acknowledge and accept the irreversible nature of cryptocurrency transactions.

5.6 Processing Time

Exchange processing times typically range from 5 to 30 minutes but may vary depending on network congestion, blockchain confirmation requirements, and other factors outside our control. ChangeCoinNow is not liable for delays caused by network congestion, blockchain issues, or other external factors.

6. Fees

Exchange rates displayed on the Service include all applicable service fees, network fees, and liquidity provider fees. There are no hidden charges. The amount you see at the time of exchange creation is the estimated amount you will receive, subject to market fluctuations for standard rate exchanges.

Blockchain network fees (also known as miner fees or gas fees) for the outgoing transaction are included in the exchange rate. However, any fees charged by your sending wallet or exchange for the deposit transaction are your responsibility.

7. Prohibited Activities

You agree not to use the Service for any of the following purposes:

• Money laundering or the concealment of proceeds from illegal activities.
• Financing of terrorism or activities related to weapons of mass destruction.
• Tax evasion or circumvention of tax obligations.
• Fraud, deception, or misrepresentation of any kind.
• Violation of any applicable sanctions, embargoes, or trade restrictions.
• Exchange of cryptocurrency that has been obtained through theft, hacking, ransomware, or other criminal activity.
• Interfering with, disrupting, or attempting to gain unauthorized access to the Service, its servers, or connected networks.
• Using automated scripts, bots, or other tools to interact with the Service in a manner that could overload, damage, or impair its functionality.
• Attempting to circumvent any security measures, rate limits, or access restrictions implemented by the Service.
• Impersonating any person or entity, or falsely representing your affiliation with any person or entity.

8. AML/KYC Compliance

ChangeCoinNow is committed to preventing money laundering and terrorist financing. We reserve the right to implement identity verification procedures in compliance with applicable regulations. These procedures may include, but are not limited to:

• Requesting government-issued identification documents.
• Verifying your residential address through utility bills or bank statements.
• Screening against international sanctions lists and politically exposed persons (PEP) databases.
• Monitoring transactions for suspicious patterns or activity.

If verification is requested and you fail to provide the required information within a reasonable timeframe, the transaction may be suspended or cancelled, and funds may be withheld until compliance requirements are satisfied.

We cooperate with law enforcement agencies and regulatory authorities. We may disclose transaction information and user data in response to valid legal requests, court orders, or regulatory requirements.

9. Intellectual Property

All content on the Service, including but not limited to text, graphics, logos, icons, images, software, and the compilation thereof, is the property of ChangeCoinNow or its licensors and is protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes in accordance with these Terms. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content from the Service without our prior written consent.

10. Third-Party Services

The Service relies on third-party liquidity providers, blockchain networks, and other external services to facilitate cryptocurrency exchanges. ChangeCoinNow is not responsible for the availability, reliability, accuracy, or performance of any third-party service.

Links to third-party websites or services that may appear on the Service are provided for informational purposes only. We do not endorse, control, or assume responsibility for the content, privacy policies, or practices of any third-party website or service.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

ChangeCoinNow does not warrant that: (a) the Service will be uninterrupted, timely, secure, or error-free; (b) the results obtained from the use of the Service will be accurate or reliable; (c) any errors in the Service will be corrected; or (d) the Service will be free of viruses or other harmful components.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CHANGECOINNOW, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, WHETHER ARISING FROM CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE EXCEED THE TOTAL AMOUNT OF FEES PAID BY YOU TO CHANGECOINNOW IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You acknowledge that cryptocurrency markets are highly volatile and that exchange rates can change rapidly. ChangeCoinNow is not liable for any losses resulting from price fluctuations, market movements, or the difference between estimated and actual exchange amounts.

13. Indemnification

You agree to indemnify, defend, and hold harmless ChangeCoinNow, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) your infringement of any right of a third party.

14. Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Service shall first be attempted to be resolved through good-faith negotiation between the parties. If a dispute cannot be resolved through negotiation within thirty (30) days, either party may submit the dispute to binding arbitration in accordance with the rules of a mutually agreed-upon arbitration body.

15. Force Majeure

ChangeCoinNow shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, riots, government actions, power failures, internet or telecommunications failures, blockchain network outages, DDoS attacks, or other similar events.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

17. Entire Agreement

These Terms of Use, together with the Privacy Policy and Risk Disclosure Statement, constitute the entire agreement between you and ChangeCoinNow with respect to the use of the Service. These Terms supersede all prior or contemporaneous communications, agreements, and understandings between the parties, whether oral or written.
